第1条(適用範囲)

1. 当社がHASOに関し、宿泊客との間で締結する宿泊契約及びこれに関連する契約は、この約款の定めるところによるものとし、この約款に定めのない事項については、法令又は一般に確立された慣習によるものとします。
2. 当社が法令及び慣習に反しない範囲で特約に応じたときは、前項の規定にかかわらず、その特約が優先するものとします。

第2条(宿泊契約の申し込み)

1. 当社に宿泊契約の申込みをしようとする方は、次の事項を申し出ていただきます。 (1) 宿泊者名
(2) 宿泊日及び到着予定時刻
(3) 宿泊料金(諸税を含む)
(4) その他当社が必要と認める事項
2. 宿泊客が宿泊中に前項第2号の宿泊日を越えて宿泊の継続を申し入れた場合、当社は、その申し出がなされた時点で新たな宿泊契約の申込みがあったものとして処理します。

第3条(宿泊契約の成立等)

1. 宿泊契約は、当社が前条の申込みを承諾したとき、承諾の旨をHASO公式サイト(以下、当サイトといいます)に表示した時、または、その旨の電子メールが宿泊客の指定するメールアドレスを管理するサーバーに到達した時に成立するものとします。
2. 前項の規定により宿泊契約が成立したときは、宿泊期間(3日を超えるときは3日間)の基本宿泊料を限度として当社が定める申込金を、当社が指定する日までにお支払いいただきます。
3. 申込金は宿泊客が最終的に支払うべき宿泊料金に充当し、第6条及び第18条の規定を適用する事態が生じたときは、違約金に次いで賠償金の順序で充当し、残額があれば第12条の規定による料金の支払いの際に返還します。
4. 第2項の申込金を同項の規定により当社が指定した日までにお支払いいただけない場合は、宿泊契約はその効力を失うものとします。但し、申込金の支払期日を指定するに当り、当社がその旨を宿泊客に告知した場合に限ります。
5. 当社が当サイトに誤った宿泊料金を提示し、当該宿泊料金に基づき宿泊契約の申込みをされ、当社が承諾した場合は、当該料金がその前後の期日の宿泊料金に比べて著しく低廉であるときは、当該料金につき「限定」、「特別」、「キャンペーン」等の低廉である理由の表示のない限りは、民法上の錯誤による承諾であることから、宿泊契約は無効とさせていただき、速やかにその旨の通知を差し上げます。


第4条(申込金の支払いを要しない特約)

1. 前条第2項の規定にかかわらず、当社は、契約の成立後同項の申込金の支払いを要しないこととする特約に応じることがあります。
2. 宿泊契約の申込みを承諾するに当り、当社が前条第2項の申込金の支払いを求めなかった場合及び当該申込金の支払期日を指定しなかった場合は、前項の特約に応じたものとして取り扱います。

第5条(宿泊契約締結の拒否)

1. 当社は、次に掲げる場合において、宿泊契約の締結に応じないことがあります。
(1) 宿泊の申込みが、この約款によらないとき。
(2) 満室により客室の余裕がないとき。
(3) 宿泊しようとする者が、宿泊に関し、法令の規定、公の秩序若しくは善良の風俗に反する行為をするおそれがあると認められるとき。
(4) 宿泊しようとする者が次のイからハに該当すると認められるとき。
イ) 暴力団員による不当な行為の防止等に関する法律(平成3年法律第77号)第2条第2号に規定する暴力団(以下「暴力団」という。)、同条第2条第6号に規定する暴力団員(以下「暴力団員」という。)、暴力団準構成員又は暴力団関係者その他の反社会的勢力
ロ) 暴力団又は暴力団員が事業活動を支配する法人その他の団体であるとき
ハ) 法人でその役員のうちに暴力団員に該当する者があるもの
(5) 宿泊しようとする者が、他の宿泊者に著しい迷惑を及ぼす言動をした場合。
(6) 宿泊しようとする者が、当社もしくはその従業員に対し暴力的要求行為を行い、または合理的範囲を超える負担を要求した場合。
(7) 宿泊しようとする者が、伝染病者であると明らかに認められるとき。
(8) 天災、施設の故障、その他やむをえない事由により宿泊させることができないとき。
(9) 各都道府県条例で特に定める事由があるとき。
(10) 保護者の許可のない未成年のみが宿泊するとき。
(11) 宿泊の申し込みをした者が、予約した部屋につき経済的利益を図る目的を秘して申し込みをしたとき。


第6条(宿泊客の契約解除権)

1. 宿泊客は、当社に申し出て、宿泊契約を解除することができます。
2. 当社は、宿泊客がその責めに帰すべき事由により宿泊契約の全部又は一部を解除した場合(第3条第2項の規定により当社が申込金の支払期日を指定してその支払いを求めた場合であって、その支払いより前に宿泊客が宿泊契約を解除したときを除きます。)は、HASO公式サイトの予約ページ又は各旅行予約サイトに記載する違約金を申し受けます。但し、当社が第4条第1項の特約に応じた場合にあっては、その特約に応じるに当たって、宿泊客が宿泊契約を解除したときの違約金支払義務について、当社が宿泊客に告知したときに限ります。
3. 当社は、宿泊客がその責めに帰すべき事由により宿泊契約の全部又は一部を解除した場合(第3条第2項の規定により当社が申込金の支払期日を指定してその支払いを求めた場合であって、その支払いより前に宿泊客が宿泊契約を解除したときを除きます。)は、HASO公式サイトの予約ページ又は各旅行予約サイトに記載する違約金を申し受けます。但し、当社が第4条第1項の特約に応じた場合にあっては、その特約に応じるに当たって、宿泊客が宿泊契約を解除したときの違約金支払義務について、当社が宿泊客に告知したときに限ります。
4. 当社は、宿泊客がその責めに帰すべき事由により宿泊契約の全部又は一部を解除した場合(第3条第2項の規定により当社が申込金の支払期日を指定してその支払いを求めた場合であって、その支払いより前に宿泊客が宿泊契約を解除したときを除きます。)は、HASO公式サイトの予約ページ又は各旅行予約サイトに記載する違約金を申し受けます。但し、当社が第4条第1項の特約に応じた場合にあっては、その特約に応じるに当たって、宿泊客が宿泊契約を解除したときの違約金支払義務について、当社が宿泊客に告知したときに限ります。
5. 当社は、宿泊客が連絡をしないで宿泊当日の午後3時(予め到着予定時刻が明示されている場合は、その時刻を30分経過した時刻)になっても到着しないときは、その宿泊契約は宿泊客により解除されたものとみなし処理することがあります。


第7条(当社の契約解除権)

1. 当社は、次に掲げる場合においては、宿泊契約を解除することがあります。
(1) 宿泊客が宿泊に関し、法令の規定、公の秩序若しくは善良の風俗に反する行為をする恐れがあると認められるとき、または同行為をしたと認められるとき。
(2) 宿泊客が次のイからハに該当すると認められるとき。
イ) 暴力団、暴力団員、暴力団準構成員又は暴力団関係者その他の反社会的勢力
ロ) 暴力団又は暴力団員が事業活動を支配する法人その他の団体であるとき
ハ) 法人でその役員のうちに暴力団員に該当する者があるもの
(3) 他の宿泊者に著しい迷惑を及ぼす言動をした場合。
(4) 宿泊客が伝染病者であると明らかに認められるとき。
(5) 当社もしくはその従業員に対し、暴力的要求行為を行い、または合理的範囲を超える負担を要求した場合。
(6) 天災等不可抗力に起因する事由により宿泊させることができないとき。
(7) 寝室での寝たばこ、消防用設備に対するいたずら、その他当社が定める利用規則の禁止事項に従わないとき。
(8) 宿泊契約成立後に第5条(10)(11)に定める事由が判明したとき。
(9) 宿泊客がこの約款、当社の利用規則その他別途定める約款等に違反したとき。
2. 当社が前項の規定に基づいて宿泊契約を解除したときは、宿泊客がいまだ提供を受けていない宿泊サービス等の料金はいただきません。但し、前項第6号以外の事由による場合には、いまだ提供を受けていない宿泊等のサービス等の料金相当額の違約金を申し受けます。この場合、第18条に基づく請求を妨げられるものではありません。

第8条(宿泊の登録)

1. 宿泊客は、宿泊当日までに、当社が案内する事前チェックインフォームにおいて、次の事項を登録していただきます。
(1) 宿泊客の氏名、年齢、性別、住所及び職業
(2) 外国人にあっては、国籍、旅券番号、入国地及び入国年月日
(3) 出発日及び出発予定時刻
(4) その他、当社が必要と認める事項
2. 宿泊客は、宿泊当日までに、当社が案内する事前チェックインフォームにおいて、次の事項を登録していただきます。宿泊客が第12条の料金の支払いを、宿泊券、クレジットカード等通貨に代わり得る方法により行おうとするときは、予め前項の登録時にそれらを提示していただきます。

第9条(客室の使用時間)

宿泊客が当社の客室を使用できる時間は、午後3時から翌朝午前11時までとします。但し、連続して宿泊する場合においては、到着日及び出発日を除き、終日使用することができます。

第10条(利用規則の遵守)

宿泊客は、当社内においては、当社がご案内する利用規則に従っていただきます。

第11条(営業時間)

1. 当社の主な施設等の営業時間は、備え付けパンフレット、客室内のタブレット等でご案内いたします。
2.前項の時間は、必要やむを得ない場合には臨時に変更することがあります。その場合には適当な方法をもってお知らせします。

第12条(料金の支払い)

1. 宿泊客が支払うべき宿泊料金等の内訳及びその算定方法は、当社と宿泊客が個別に合意した料金によるものとします。
2. 前項の宿泊料金等の支払いは、予約サイトにおいて行っていただきます。
3. 当社が宿泊客に客室を提供し、使用が可能になったのち、宿泊客が任意に宿泊しなかった場合においても、宿泊料金は申し受けます。

第13条(当社の責任)

当社は、宿泊契約及びこれに関連する契約の履行に当り、又はそれらの不履行により宿泊客に生じた損害を賠償します。但し、それが当社の責めに帰すべき事由によるものではないときは、この限りではありません。

第14条(契約客室の提供ができないときの取り扱い)

1. 当社は、宿泊客に契約した客室を提供できないときは、宿泊客の了解を得て、できる限り同一の条件による他の宿泊施設を斡旋するものとします。
2. 当社は、前項の規定にかかわらず他の宿泊施設の斡旋ができないときは、違約金相当額の補償料を宿泊客に支払い、その補償料は損害賠償額に充当します。但し、客室が提供できないことについて、当社の責めに帰すべき事由がないときは、補償料を支払いません。

第15条(寄託物等の取扱い)

1. 宿泊客が当社にお預けになった物品又は現金並びに貴重品について、滅失、毀損等の損害が生じたときは、それが、不可抗力である場合を除き、当社は、その損害を賠償します。但し、現金及び貴重品については、当社がその種類及び価額の明告を求めた場合であって、宿泊客がそれを行わなかったときは、当社は15万円賠償責任保険を限度としてその損害を賠償します。
2. 宿泊客が、当社内にお持込みになった物品又は現金並びに貴重品であってお預けにならなかったものについて、当社の故意又は過失により滅失、毀損等の損害が生じたときは、当社は、その損害を賠償します。但し、宿泊客から予め種類及び価額の明告のなかったものについては、15万円若しくは賠償責任保険を限度として当社はその損害を賠償します。

第16条(宿泊客手荷物又は携帯品保管)

1. 当社では、チェックイン時間前及びチェックアウト時間後に荷物のお預かりは行っておりません。また、事前配達等による荷物のお預かりも行っておりません。
2. 宿泊客がチェックアウトしたのち、宿泊客の手荷物又は携帯品が当社に置き忘れられていた場合、発見日を含め7日間保管し、そ の後最寄りの警察署に届けます。また飲食物の場合は、当日に処理いたします。
3. 前2項の場合における宿泊客の手荷物又は携帯品の保管について、当社の責任は、第1項の場合にあっては前条第1項の規定に、前項の場合にあっては同条第2項の規定に準ずるものとします。

第17条(宿泊客の責任)

宿泊客によるこの約款もしくは利用規則に違反する行為及びその他、以下のような宿泊客の責に帰すべき事由により、当社が客室の清掃・修繕費用の支出、販売機会の喪失その他の損害を被ったときは、宿泊客に、当社が被った損害を賠償していただきます。
1. ホテルの設備・備品の破損、盗難等が認められた場合
2. 飲食、嘔吐、血液、体液、汚損等によりホテルの通常利用を超える特別清掃を要する場合
3. ホテル内で喫煙が認められた場合

第18条(裁判管轄及び準拠法)

本約款による宿泊契約及びこれに関連する契約に関して生じる一切の紛争については,東京地方裁判所を第一審の専属的合意管轄裁判所とし、日本の法令に従い解決されるものとします。

第19条 (駐車の責任)

宿泊客が当社の駐車場をご利用になる場合、車両のキーの寄託の如何にかかわらず、当社は場所をお貸しするものであって、車両の管理責任まで 負うものではありません。ただし、駐車場の管理に当たり、当社の故意又 は過失によって損害を与えたときは、その賠償の責めに任じます。

第20条 (宿泊客の責任)

宿泊客の故意又は過失により当社が損害を被ったときは、当該宿泊客は当社に対し、その損害を賠償していただきます。

Article 1 (Scope of application)

Article 2 (Application for accommodation contract)

2. If the guest requests during the stay to continue the stay beyond the date of stay as specified in item (2) of the preceding paragraph, the Company shall treat the request as a new application for an accommodation contract at the time such request is made.

Article 3 (Formation of Accommodation Contract, etc.)

1. An accommodation contract shall be formed when the Company has accepted the application as described in the preceding article, when the Company displays the acceptance on the official HASO website (hereinafter referred to as the "Website"), or when an e-mail to that effect reaches the server that manages the e-mail address designated by the accommodation guest.
2. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, the guest shall pay an application fee determined by the Company up to the basic accommodation charge for the period of stay (3 days when exceeding 3 days) by the date designated by the Company.
3. the deposit shall be appropriated to the accommodation charge ultimately payable by the guest, and in the event that the provisions of Articles 6 and 18 apply, the deposit shall be appropriated in the order of penalty followed by compensation, and any remaining amount shall be returned upon payment of the charge pursuant to the provisions of Article 12.

In the event that the application fee stipulated in Paragraph 2 is not paid by the date designated by the Company in accordance with the provisions of the same paragraph, the accommodation contract shall cease to be effective. However, this shall apply only when the Company has notified the guest to that effect when designating the date for payment of the application fee.
5. In the event that the Company has presented an incorrect accommodation charge on this Website and the guest has applied for an accommodation contract based on said charge and the Company has accepted the application, if said charge is significantly lower than the accommodation charge for the preceding and following dates, unless the reason for the lower charge is indicated as "limited," "special," "campaign" or the like, said charge shall not be deemed to be an accommodation contract unless the Company has notified the guest of the reason for such lower rate. In this case, the accommodation contract will be considered invalid and we will promptly notify you of the invalidity of the accommodation contract.

Article 4 (Special Contract that Does Not Require Payment of Subscription Fee)

1. notwithstanding the provisions of paragraph 2 of the preceding article, the Company may accept a special contract in which the payment of the application fee set forth in the same paragraph is not required after the conclusion of the contract.
2. if, in accepting an application for an accommodation contract, the Company does not require payment of the application fee as set forth in Paragraph 2 of the preceding article or does not specify the due date for payment of said application fee, the Company shall treat such application as having complied with the special agreement set forth in the preceding paragraph.

Article 5 (Refusal to enter into an accommodation contract)

1. The Company may refuse to conclude an accommodation contract in the following cases
(1) When the application for accommodation is not in accordance with the provisions of these clauses.
(2) When there is no room available due to full occupancy.
(3) When it is recognized that the person seeking accommodation is likely to conduct himself/herself in a manner contrary to the provisions of the law, public order, or good morals in connection with the accommodation.
(4) When it is recognized that the person who intends to stay falls under any of the following (a) through (c).
a) When it is recognized that the person who intends to stay falls under a) to c) below. b) When it is recognized that the person who intends to stay falls under a) to c) below. c) When it is recognized that the person who intends to stay falls under b) to d) below. (8) When we are unable to accommodate the guest due to a natural disaster, a breakdown of the facilities, or other unavoidable reasons.
(9) When there are special reasons stipulated by prefectural ordinances.
(10) When only minors are staying without the permission of their guardians.
(11) When the person making the application for lodging has made the application with the intention of making a financial profit from the reserved room.

Article 6 (The guest's right to cancel the contract)

1. the guest may cancel the accommodation contract by making an offer to the Company.
2. in the event that the hotel guest cancels all or part of the accommodation contract for reasons attributable to the hotel guest (except in the event that the Company specifies the due date for payment of the application fee and requires payment thereof pursuant to Article 3, paragraph 2, and the hotel guest cancels the accommodation contract prior to such payment), the Company shall ), the Company shall charge the penalty fee stated on the reservation page of the HASO official website or each travel reservation website. Article 7 (Our right to cancel the contract)

1. The Company may cancel the accommodation contract in the following cases
(1) When it is recognized that the guest is likely to commit an act contrary to the provisions of law, public order, or good morals in connection with the accommodation, or when it is recognized that the guest has committed such an act.
(2) When a guest is found to fall under any of the following (a) through (c)
a) When the guest is a crime syndicate, a member of a crime syndicate, a quasi-constituent of a crime syndicate, or a person related to a crime syndicate or other antisocial force b) When the guest is a corporation or other organization whose business activities are controlled by a crime syndicate or a member of a crime syndicate c) When the guest is a corporation whose officers include persons falling under the category of crime syndicate members (3) When the guest has said or done something that causes significant trouble to other guests
(4) When it is clearly recognized that the guest is a person with a contagious disease
(5) The guest commits an act of violent demand against the Company or its employees, or demands a burden exceeding a reasonable extent.
(6) When the Company is unable to accommodate the guest due to a force majeure such as a natural disaster.
(7) When the guest does not comply with the prohibition of smoking in the bedroom, tampering with the fire fighting equipment, or other usage rules stipulated by the Company.
(8) When the reasons specified in Article 5 (10) and (11) are found after the accommodation contract is concluded.
(9) When the Guest has violated these General Terms and Conditions, the Company's Rules of Use, or any other separately stipulated terms and conditions, etc.

2. When the Company cancels the accommodation contract based on the provisions of the preceding paragraph, no charge for accommodation services, etc. which have not yet been provided to the guest shall be made. However, in the event that the cancellation is due to a reason other than item 6 of the preceding paragraph, a penalty charge equivalent to the charges for accommodation and other services that have not yet been provided to the guest will be assessed. In this case, the claim based on Article 18 shall not be precluded.

Article 8 (Registration for Accommodation)

1. The guest shall register the following items on the advance check-in form provided by the Company prior to the day of stay.
(1) Name, age, sex, address and occupation of the guest (2) Nationality, passport number, place of entry and date of entry for a foreigner (3) Departure date and scheduled departure time (4) Other items deemed necessary by the Company
2. The guest shall register the following items on the advance check-in form provided by the Company prior to the day of stay. If the guest intends to pay the charges as described in Article 12 by a method that can be substituted for currency, such as a room voucher or credit card, the guest shall present them in advance at the time of registration as described in the preceding paragraph.

Article 9 (Hours of use of guest rooms)

Guests may use the Company's guest rooms from 3:00 p.m. to 11:00 a.m. the following morning. However, in the case of a consecutive stay, a guest may use the room for the entire day, except for the day of arrival and the day of departure.

Article 10 (Compliance with Rules of Use)

Guests shall comply with the Rules of Use provided by the Company.

Article 11 (Business Hours)

1. The business hours of the Company's main facilities, etc. will be announced in the brochures provided, on the tablets in the rooms, etc.
2. The hours in the preceding paragraph may be changed temporarily if necessary or unavoidable. In such cases, we will notify you by appropriate means.

Article 12 (Payment of Fees)

1. The breakdown of accommodation charges, etc., payable by the guest and the method of calculation thereof shall be in accordance with the rates individually agreed upon by the Company and the guest.
2. The payment of the room charge, etc. as described in the preceding paragraph shall be made on the reservation site.
3. After we have provided a guest room and made it available for use, we will charge the room charge even if the guest voluntarily does not stay in the room.

Article 13 (Liability of the Company)

The Company shall compensate for damages incurred by the guest in the performance of the accommodation contract and related agreements or in the non-fulfillment thereof. However, this shall not apply when the damage is not caused by reasons attributable to the Company.

Article 14 (Treatment when a contracted guest room cannot be provided)

1. When the Company is unable to provide the contracted guest room, the Company shall, with the consent of the guest, mediate other accommodation facilities under the same conditions as far as possible.
2. If, notwithstanding the provisions of the preceding paragraph, the Company is unable to arrange other accommodation, the Company shall pay the guest a compensation fee equivalent to the amount of the penalty charge, which shall be applied to the amount of compensation for damages. However, if there is no reason attributable to the Company for not being able to provide the guest room, the compensation fee shall not be paid.

Article 15 (Handling of Deposited Items, etc.)

1. In the event of loss, damage, etc. to articles, cash, or valuables entrusted to the Company by the guest, the Company shall compensate for such damage, except in cases where such damage is caused by force majeure. However, in the event that the Company requires the guest to disclose the type and value of cash and valuables, and the guest fails to do so, the Company shall compensate for such damages up to the limit of 150,000 yen liability insurance. 2.

In the event that the guest brings into the hotel any articles, cash, or valuables that he/she did not leave with the Company, and if such articles, cash, or valuables are lost or damaged due to the intentional or negligent act of the Company, the Company shall compensate for such damages. However, if the type and value of the items are not specified by the guest in advance, the Company shall compensate for such damages up to the amount of 150,000 yen or liability insurance.

Article 16 (Storage of guest's baggage or personal belongings)

If a guest's luggage or personal belongings are left behind at the hotel after the guest has checked out, the hotel will keep them for 7 days, including the day they are found, and then report them to the nearest police station. Article 17 (Liability of the guest)

In the event that the Company incurs expenses for cleaning and repairing guest rooms, loss of sales opportunities, or other damages due to an act by a guest in violation of these General Terms and Conditions or the Rules of Use, or for any other reason attributable to the guest, as described below, the Company shall ask the guest to compensate for the damages incurred by the Company.
1. In the event of damage to hotel facilities or equipment, theft, etc.
2. When special cleaning beyond the normal use of the hotel is required due to eating, drinking, vomiting, blood, body fluids, stains, etc.
3. If smoking is found in the hotel.

Article 18 (Jurisdiction and Governing Law)

Any and all disputes arising out of or in connection with the accommodation agreement and other related agreements pursuant to these terms and conditions shall be settled in the Tokyo District Court as the court of exclusive jurisdiction of the first instance, in accordance with the laws of Japan.

Article 19 (Responsibility for Parking)

When a guest uses the parking lot of the Company, regardless of whether or not he/she deposits the key to the car, the Company rents the parking lot to the guest and does not assume responsibility for the management of the car. However, if the Company intentionally or negligently causes damage in the management of the parking lot, the Company shall be liable to compensate for such damage.

Article 20 (Liability of Guests)

In the event that the Company suffers damages due to the guest's intention or negligence, said guest shall compensate the Company for such damages.
